Do I need a lawyer to buy property in Spain?

A lawyer is not legally required – only a notary and the Land Registry are – but for foreign buyers an independent lawyer is strongly recommended. The notary certifies the deed's formal legality; they do not represent your interests, run title and debt due diligence, or negotiate for you. SFERO works with independent Spanish lawyers who protect you before, during and after the purchase.

What taxes do I pay when buying property in the Valencia region?

For resale homes in the Comunidad Valenciana, transfer tax (ITP) is 9% as of June 2026 (reduced from 10% by Ley 5/2025), rising to 11% above €1 million. New-builds are taxed at 10% VAT plus 1.4% stamp duty (AJD). Budget roughly 11–13% of the price in total, including notary, Land Registry and legal fees.

What is the NIE and is it mandatory to buy?

The NIE (Número de Identidad de Extranjero) is your permanent Spanish tax and identity number. It is mandatory to sign the purchase deed, open a bank account and pay property taxes. You can obtain it at a Spanish consulate abroad, in person in Spain, or through a lawyer holding your power of attorney – which is how most overseas buyers complete a purchase without traveling.

What is the Beckham Law, and does buying property qualify me for it?

The Beckham Law is a special expat tax regime that lets qualifying new residents pay a flat 24% on Spanish employment income up to €600,000 for six tax years. It is triggered by a qualifying work relocation to Spain – buying property does not trigger it and does not make you eligible. We coordinate with tax advisers to check whether your situation qualifies.

What taxes do non-resident property owners pay each year?

Every owner pays IBI, the annual local property tax set by the town hall. Non-residents also file an annual non-resident income tax return (Modelo 210): on an unrented home the taxable base is 1.1–2% of the cadastral value, and rental income is taxed at 19% for EU/EEA residents or 24% for non-EU residents. We handle the filings so nothing is missed.

Can I buy a property in Spain without traveling there?

Yes. With a notarised, apostilled power of attorney, your lawyer can obtain your NIE, open your bank account and sign the deed on your behalf, so you can complete the purchase entirely from abroad.
